StoryBoom Terms

TERMS OF USE
These Terms of Use (“Terms”) govern your access to and use of the StoryBoom web application and related services (“Service”), operated by Internet Art World Gallery, Inc., DBA: StoryBoom (“StoryBoom”, “we”, “us”, and “our”). By using the Service, you agree to these Terms. Please read them carefully.

LIMITATION OF LIABILITY
To the fullest extent permitted under applicable law, you understand and agree that neither StoryBoom nor any of its subsidiaries, affiliates or third-party content providers shall be liable for any direct, indirect, incidental, special, consequential, punitive or any other damages relating to or resulting from your use or inability to use this site or any other site you access through a link from this site or from any actions we take or fail to take as a result of electronic mail messages you send us. These include damages for errors, omissions, interruptions, defects, delays, computer viruses, your loss of profits, loss of data, unauthorized access to and alteration of your transmissions and data, and other tangible and intangible losses.

This limitation applies regardless of whether the damages are claimed under the terms of a contract, as the result of negligence or otherwise, and even if we or our representatives have been negligent or have been advised of the possibility of such damages.

YOUR LIABILITY
If you cause a technical disruption of the site or the systems transmitting the site to you or others, you agree to be responsible for any and all liabilities, costs, and expenses (including attorneys’ fees) arising from that disruption.

1. Subscription Plans and Pricing

StoryBoom offers both free and paid subscription plans. Details about our subscription offerings are available here. Pricing may vary by location and is determined based on the billing information provided at the time of purchase.

  • Scene Limit: As you reach the limit of 80 scenes, you will need to select the next paid option to continue expanding your scene capacity.
  • Additional Members: If your team reach the limit of 3 members, you will need to select the paid option and you will be billed according to StoryBoom’s “Add as You Grow” model.
  • Enterprise Plan: If you are on a StoryBoom Enterprise Plan, the Plan Owner is responsible for all subscription fees.

Changes to Pricing: We reserve the right to modify pricing at any time. For existing subscriptions, pricing changes will take effect at the next renewal or thirty (30) days after notice, whichever is later.

2. Payment and Cancellation

Payment Processing: All payments are processed securely through Stripe Inc., our third-party payment processor. By making a payment, you agree to Stripe’s terms and conditions available at Stripe.com. Any disputes regarding payment processing must be addressed directly with Stripe.

Cancellation Policy: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the end of the current billing cycle, and no refunds will be issued for fees already paid. Any outstanding fees must be paid upon cancellation.

3. User Registration and Responsibilities

To access certain features of StoryBoom, you may be required to register an account. When registering, you must provide accurate and complete information.

  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access or security breaches.
  • Access Responsibility: You are responsible for ensuring all users accessing the Service through your internet connection comply with these Terms.

4. User Content

You retain ownership of any content you upload or create using the Service ("User Content"). By using StoryBoom, you grant us a non-exclusive, royalty-free, sublicensable license to host, store, and display your content solely for providing the Service to you.

Content Rights and Responsibilities:

  • You represent and warrant that you have the necessary rights to your content.
  • If you share content with others, you grant StoryBoom a perpetual license to continue hosting and displaying that content as needed.

5. Use of the Service

You agree to use the Service for its intended purposes and comply with all applicable laws and regulations. Prohibited uses include, but are not limited to:

  • Violating intellectual property rights.
  • Uploading harmful, offensive, or illegal content.
  • Engaging in activities that could harm the Service or other users.

6. Availability and Termination

StoryBoom does not guarantee that the Service will always be available or uninterrupted. We may suspend, withdraw, or modify the Service at any time without notice.

We reserve the right to terminate your access for violations of these Terms or other harmful activities.

7. Limitation of Liability

To the fullest extent permitted by law, StoryBoom and its affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Data loss.
  • Service interruptions.
  • Unauthorized access to your account.

8. Intellectual Property

All proprietary rights to the Service, including design, code, and underlying technology, belong to StoryBoom. You may not copy, modify, or distribute any part of the Service without prior written consent.

9. Dispute Resolution

Any disputes arising out of these Terms will be resolved through arbitration under the rules of the American Arbitration Association.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data.
